Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted (...) the dialogue at the City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Charles Curran and James Keenan are two of the foremost Catholic ethicists in the United States today. Keenan’s case is to be applauded for convening the 2010 conference in Trento, which brought together some six hundred Roman Catholic ethicists from around the world. His book, which assembles that conference’s thirty-one plenary addresses, does justice to this tremendous feat. Curran, for his part, has produced a text that focuses acutely on the Church in the United States and will benefit ethicists for years to come.Keenan uses the introduction to Catholic Theological Ethics Past, Present, and Future to provide an overview of the Trento conference and its attendees and proceedings. Keenan expertly identifies a common theme among the 240 diverse papers at the conference, noting that ethicists “always begin with the premise that there is a deficit in our location, and, therefore, we need to work together to find a way to remedy it” (6). What follows in the remainder of the book boldly moves toward remedies for many of the world’s ills. A few of these essays deserve particular mention.The conference and the collection of essays share the basic organizational principle of looking to the past, the present, and the future of Catholic theological ethics. Unsurprisingly, the Council of Trent played a foundational role in understanding the “past” of Catholic moral theology. Laurenti Magesa [End Page 216] (Kenya) explains that the African experience of the Council of Trent has remained largely unchanged since the conclusion of that council: “The Catholic Church in Africa is essentially a Tridentine church” (57). This essay makes clear that in Africa, the dominant voices are Western males. The missing voices, then, are given attention by Antônio Moser (Brazil), Anne Nasimiyu-Wasike (Kenya), and Bryan Massingale (United States). Massingale’s essay was most impressive, addressing the role of racism in our culture and concluding that Catholic ethicists “need to lament, mourn, and grieve our history” (121). This, he claims, is both a fruitful way to act in the present and a hopeful way to look toward the future.In focusing on the present, the strongest subsection of the book attended to political ethics. Here David Kaulemu’s (Zimbabwe) essay, “Catholic Social Teaching at a Crossroad,” has the potential to open the eyes of any reader. He writes, “It is frustrating and discouraging to the lay faithful to be inspired by Catholic social teaching and yet receive no recognition or support by ‘official’ church structures” (177). This highlights a serious problem to which all Catholic ethicists must attend. As for the future, Julie Hanlon Rubio (United States) points to a tripartite vision for marriage in the twenty-first century that sets high standards not only within the marital unit itself but also for the impact of the spouses on the larger society. Julie Clague (Scotland) presents a wonderful essay on the burgeoning relationship between moral theology and gender.Among the wealth of positive features of this collection is the great geographical diversity of the authors. This affirms that Catholic theological ethics is very healthy throughout the entire world and that on each continent there are voices of women and men willing to contribute fresh ideas to the discipline. Compelled by recent public and politicized cases in which withdrawal of nutrition and hydration were at issue, this essay examines recent Church statements and argues that the distinction between private and public forms of human life is being lost. Effacing the distinction between the sphere of the home (oikos), where the maintenance of life (zoē) occurs, and the city (polis), where political and public life (bios) occurs, may have unforeseen and unwanted consequences. Through their well-intentioned efforts to preserve the sanctity (...) of life, certain bishops and the Congregation for the Doctrine of the Faith have unfortunately brought political considerations into the home, taking decision-making authority away from those most intimately related to the patient. Thus, the question of removing nutrition and hydration in the case of patients such as Schiavo and Englaro becomes politicized and abstract, in contrast with the Church's previous positions on the importance of proportionate means in the maintenance of life, local decision making, and its recognition of life as a penultimate end. ABSTRACT Republic Act 9710, or the Magna Carta of Women (MCW), is considered the Philippine version or national law translation of the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW). Using the concept of impact translation as a framework and the Feminist Critical Discourse Analysis (FCDA) approach, this article examines the MCW and the minutes of committee meetings, particularly the bicameral conference committee meeting where lawmakers agreed on the finalized version of the bill. It applies (...) the concept of gender relationality in examining how legislators negotiated the provisions of the MCW, particularly those on reproductive health and the definition of gender. The analysis shows that these provisions challenged Catholic doctrines specifically on gender, childbearing, and pre-marital sexual relations. It argues that the Catholic conception of gender norms and women’s role in society shaped the law’s final version, disregarding the CEDAW Committee recommendations on abortion. Findings suggest that the legislators’ fear that the law’s ratification would serve as an opening for the legalization of abortion led to a weakened version of the law, particularly the section on women’s reproductive health. On the assumption that theistic religious commitment takes place in the face of evidential ambiguity, the question arises under what conditions it is permissible to make a doxastic venture beyond one’s evidence in favour of a religious proposition. In this paper I explore the implications for orthodox theistic commitment of adopting, in answer to that question, a modest, moral coherentist, fideism. This extended Jamesian fideism crucially requires positive ethical evaluation of both the motivation and content of religious doxastic ventures. I (...) suggest that, even though the existence of horrendous evil does not resolve evidential ambiguity in favour of atheism, there are reasonable value commitments that would preclude those who hold them from satisfying extended Jamesian fideist conditions for committing themselves to classical theism. I then begin a discussion of a possible revisionary theistic alternative (in the Christian tradition) which – one might hope – may meet those conditions. In this paper we wish to develop recent scholarship on the second-person by means of a phenomenological analysis of a doctor-patient interaction. In (...) such an interaction the doctor and patient continuously shift between the observational I-It and the interactive I-You, and recognizing the difference between observation and interaction not only helps to defend the claim that this relation is sui generis, but also uncovers the co-constitution of experience from within this relation. As we argue, engaging another second-personally involves a shared experience that is a result of incorporating the other’s mental states into one’s own while standing in the second-person relation. I, along with others, have been critical of the social construction of brain death and the various social factors that led to redefining death from cardiopulmonary failure to irreversible loss of brain functioning, or brain death. Yet this does not mean that brain death is not the best threshold to permit organ harvesting—or, as people today prefer to call it, organ procurement. Here I defend whole-brain death as a morally legitimate line that, once crossed, is grounds for families to give (...) permission for organ donation. I do so in five moves. First, I make the case that whole-brain death is a social construction that transformed one thing, coma dépassé, into another thing, brain death, as a result of social pressures. Second, I explore the way that the 1981 President’s Commission tried to establish the epistemological certainty of brain death, hoping to avoid making arcane metaphysical claims and yet still utilizing metaphysical claims about human beings. Third, I explore the moral meaning of the social construction of a definition that cannot offer metaphysical certainty about the point at which somebody becomes just some body. Fourth, I describe how two moral communities—Jewish and Catholic—actually ground their metaphysical positions with regard to brain death in the normativity of prior social relations. Finally, I conclude with a reflection on the aesthetic-moral enterprise of the metaphysical-epistemological apparatus of brain death, concluding that only such an aesthetic-moral approach is sufficiently strong to stave off the utility-maximizing tendencies of late-modern Western cultures. (bio)I shall approach the issue of justice in the allocation of scarce resources from the viewpoint of Catholic social teaching, as developed over the last century. This teaching is found primarily in the social encyclicals issued by popes from Leo XIII (1878–1903) to John Paul II (1978- ), but also in the pastoral letters of the (...) various bishops’ conferences, especially in the United States and in Latin America. These documents, which enjoy a high standing in Catholic teaching but which are not taken as binding in all their particulars, form part of a tradition of moral and social theorizing that a contemporary American would regard as “communitarian.” On social questions, this tradition also has shown itself to be historicist in that it is capable of modifying itself in significant ways in response to changing political and economic situations. It normally approaches issues from a universalist perspective, though it has shifted from a preoccupation with the concerns of the industrial societies of Europe to an advocacy of much of the reform agenda of the Third World.Rooted in classical and biblical sources and modified in the course of the last [End Page 401] century to include a principled acceptance of religious freedom, of human rights, and of democratic political institutions, the Catholic social tradition proposes a number of ideas that can serve as the basis for significant criticism of currently dominant liberal modes of organizing and interpreting advanced industrial societies. These ideas do not form a countertheory to liberalism so much as they indicate ways in which a religious organization that includes both hierarchical and egalitarian elements in its structure and that has both moral commitments and practical responsibilities with regard to health care can draw on its intellectual resources to develop alternative strategies for the reform of health care.I shall survey six ideas that figure prominently in Catholic social teaching and that are relevant to the allocation of scare resources in American health care. Space constraints require that I present them in a very condensed fashion, without tracing the complex development they have undergone in the internal Catholic debate or subjecting them to much criticism.First, Catholic social teaching, especially the great encyclical of John XXIII, Pacem In Terris (PT 1963), affirms the full range of human rights recognized in such modern documents as the Universal Declaration of Human Rights (1949). In addition to the civil and political rights enumerated in the Bill of Rights added to the original U.S. Constitution (1791), the Universal Declaration includes rights “to life, to bodily integrity, and to the means which are suitable for the proper development of life; these are primarily food, clothing, shelter, rest, medical care, and finally the necessary social services” (PT 11). Catholic social teaching has not committed itself to one particular way of institutionalizing these rights, but it effectively endorses the comprehensive West European welfare states that the Christian Democratic political parties helped to construct in the period after 1945.Second, Catholic social teaching has accorded a central organizing role to the notion of the common good, the realization of which “is the whole reason for the existence of civil authorities” (PT 54). The common good, however, is not to be understood as identical with the interest or the power of the state; rather, it “embraces the sum total of those conditions of social living whereby men are enabled to achieve their own integral perfection more fully and more easily” (PT 58; quoting Mater et Magistra). John XXIII is particularly anxious to affirm that the common good cannot be construed so as to exclude some groups or to violate the rights of individuals and that it must include both physical and spiritual goods (PT 55–61). The notion of the common good has both an inherent attractiveness and a vagueness that cries out for specification and clarification. In the last two centuries, our world would have been a safer place if philosophers such as Rousseau, Marx, and Nietzsche had not given intellectual encouragement to the radical ideologies of Jacobins, Stalinists, and fascists. Maybe the world would have been better off, from the standpoint of sound practice, if philosophers had engaged in only modest, decent theory, as did John Stuart Mill. Yet, as Ronald Beiner contends, the point of theory is not to think safe thoughts; the point is (...) to open intellectual horizons. In Philosophy in a Time of Lost Spirit, Beiner reflects on the dualism of theory and practice. The purpose of the theorist is not to offer sensible guidance on the conduct of social life but to test the boundaries of our vision of social order. Whereas the liberal citizen should embody the practical virtues of prudence and moderation, the theorist should be radical, probing, and immoderate. Looking back at the liberal-communitarian debate of the 1980s, Beiner recognizes that the antidote to our spiritless times lies neither in the embrace of community over individualism nor of individualism over community: both individual and community need to be submitted to radical questioning. It is by exposing ourselves to the challenge of fearless thinking encountered at the philosophical extremities that we are most likely to understand our own world at a deeper level. What factors are involved in the resolution of scientific disputes? What factors make the resolution of such disputes rational? The traditional view confers an important role on observation statements that are shared by proponents of competing theories. Rival theories make incompatible (sometimes contradictory) observational predictions about a particular situation, and the prediction made by one theory is borne out while the prediction made by the other is not. Paul Feyerabend, Thomas Kuhn, and Paul Churchland have called into question this account (...) of theory-resolution. According to these philosophers, substantially different and competing scientific theories are semantically incommensurable: those theories do not share a common observation language. Two charges have been leveled against the semantic incommensurability theories. The first is that it ignores that some semantic features of observational terms (e.g., their reference) can be expressed by proponents of competing theories. The second is that the semantic incommensurability thesis is self-defeating. In this paper I will argue that both of these charges are true but not for the reasons usually given. (shrink)

The ongoing struggle for GSAs in Canadian Catholic schools is one example of how clashes continue to be played out between Catholic canonical law and Canadian common law regarding sexual minorities. This paper draws (...) upon Foucault’s Discipline and Punish: The Birth of the Prison, and The History of Sexuality Vol. 1: An Introduction to analyze one particularly influential curricular and policy document entitled Pastoral Guidelines to Assist Students of Same-Sex Orientation from the Ontario Conference of Catholic Bishops. This paper posits that Catholic doctrine about non-heterosexuality functions as a Foucaultian Panopticon enabling Catholic education leaders to observe and correct the behaviour of non-heterosexual teachers and students that they deem runs counter to the values of the Vatican. This paper argues that successful resistance to the powerful disciplining regime of the Catholic school is possible. (shrink)

The responses of 178 Latin dioceses in the United States Conference of Catholic Bishops (USCCB) to the Preparatory Document for the Synod on Synodality were synthesized in fourteen regional reports. From these reports, and a report of lay groups, the USCCB produced the US report, which was synthesized with 111 other national reports into the Working Document for the Continental Stage (DCS). The latter was provided to seven continental assemblies. North American participants discussed the DCS in virtual meetings, (...) and a writing team produced the North American report. The synthesized result of the continental assemblies’ reports was the synod’s 2023 Instrumentum laboris. This article discusses US diocesan participation and the North American response to the DCS as they contributed to the Instrumentum laboris’ statement relative to “the question of women’s inclusion in the diaconate.” It includes a table documenting US diocesan responses to questions of women’s participation in the Church. This book adds to a realist account of laws of nature the framework for a related realist understanding of causation. It has two main parts: the first is concerned with laws, the second with causation. In the first main part, Tooley surveys sophisticated regularity accounts of laws and argues that none is successful. One of his central themes is that regularity accounts fail to meet the intuition that there can be underived laws which lack relevant instances--an intuition which Tooley supports (...) by appeal to two crucial examples. Tooley's diagnosis is that the reductionist assumption that the truth-makers for laws of nature are facts about particulars must be abandoned, and that laws must therefore be facts about universals. What kinds of facts? Tooley sets out a careful specification of the theoretical concept of a nomological relation. But he grants a need to go beyond this in order to make his account illuminating: Just how much has been explicated by the claim that what makes it a law that whatever has property P also has property Q is that the universals P and Q stand in a certain "nomic" relation? To answer this, and to dispel other doubts, Tooley offers the speculative suggestion that for it to be a law that whatever is P is also Q is for the conjunctive universal P-and-Q to exist, and for the universal P to exist, but only "dependently," as part of the conjunctive universal P-and-Q. Tooley argues that his specification of nomic relations can be extended to cover the case of probabilistic laws. It is unclear, however, how his speculative metaphysics could be extended to cover the probabilistic case: Can the universal P exist only to some degree as part of the conjunctive universal P-and-Q, and at the same time to another degree as part of the universal P-and-R? Doctoral programs at U.S. universities play a critical role in the development of human resources both in the United States and abroad. This volume reports the results of an extensive study of U.S. research-doctorate programs in five broad fields: physical sciences and mathematics, engineering, social and behavioral sciences, biological sciences, and the humanities. Research-Doctorate Programs in the United States documents changes that have taken place in the size, structure, and quality of doctoral education since the widely used 1982 editions. This (...) update provides selected information on nearly 4,000 doctoral programs in 41 subdisciplines at 274 doctorate-granting institutions. This volume also reports the results of the National Survey of Graduate Faculty, which polled a sample of faculty for their views on the scholarly quality of program faculty and the effectiveness of doctoral programs in preparing research scholars/scientists. This much-anticipated update of such an essential reference will be useful to education administrators, university faculty, and students seeking authoritative information on doctoral programs. The quality of doctoral-level chemistry (N=145), computer science (N=58), geoscience (N=91), mathematics (N=115), physics (N=123), and statistics/biostatistics (N=64) programs at United States universities was assessed, using 16 measures. These measures focused on variables related to: program size; characteristics of graduates; reputational factors (scholarly quality of faculty, effectiveness of programs in educating research scholars/scientists, improvement in program quality during the last 5 years); university library size; research support; and publication records. Chapter I discusses prior attempts to assess quality in graduate education, (...) development of the study plans, and the selection of disciplines and programs to be evaluated. Chapter II discusses the methodology used, focusing on each of the assessment measures. Chapters III to VIII present, respectively, findings from the analyses of the chemistry, computer science, geoscience, mathematics, physics, and statistics/biostatistics programs. Chapter IX includes a summary of results, correlations among measures, several additional analyses, and suggestions for future studies. Among the findings reported are those indicating that mathematics programs had, on the average, the largest number of faculty (N=33) in December 1980 followed closely by physics (N=28) and chemistry (N=23), and that 80 percent of computer science students had job commitments by graduation. Drawing from normal accident theory, high reliability theory, and systems theory, we analyze the Charter for the Protection of Children and Young People that is promulgated by the United States Conference of Catholic Bishops in response to the sexual abuses of minors by clergy members. Although the Charter is a step in the right direction, there remain some areas that require immediate attention. In spite of the goodwill processes, the safety of minors must remain the concerted efforts and (...) responsibilities of individuals at all the various levels if the Catholic Church is to prevent further cases of abuse from happening. This doctoral thesis examines the phenomenon of Filipinization, specifically understood as the ideological construction of a “Filipino identity” or ‘Filipino subject-consciousness” within the highly determinate context provided by the Filipino ilustrado nationalists such as José Rizal, Marcelo H. del Pilar and their fellow propagandists inasmuch as it leads to the nineteenth (19th) century construction of the modern Philippine nation. Utilizing Jacques Derrida’s deconstructive thinking, this study undertakes a genealogical critique engaged on the concrete historical examination of what is meant by (...) the term “Filipino” across a select historical timeline (1864-1898) and the various notions of Filipino identity implied by the different contexts within which the term “Filipino” has been employed. More specifically, it undertakes a selective philosophical excavation of three seminal texts in the history of Filipinization, viz.: 1) the Manifiesto of Padre Jose Burgos; 2) the writings of the Filipino ilustrados in La Solidaridad; and 3) Jose Rizal’s Annotations on Dr. Antonio de Morga’s Sucesos de las Islas Filipinas. -/- The philosophical claim of this work is the idea that Filipinization, taken as the differential construction of Filipino identity, is the effective translation of the colonial epistemic violence of Eurocentric racism and its consequent “horror of absolutism” into the homo-hegemony of Filipino nationalisms. By fetishizing the notion of a carefully constructed and essential “Filipino-identity,” Filipinization and the current nationalist discourses that utilize them, unwittingly, stands complicit with the same colonial violence and hegemony that they wish to combat. This happens precisely when the very structures of colonial oppression, on the ideological and practical levels, are transmogrified into nationalist ideals that assume legal and political power unto themselves in a self-referential and self-legitimating fashion. -/- Three processes will demonstrate the above thesis: first, by examining historical texts and setting itself against established nationalist historiographies, a genealogical analysis of the term “Filipino” reveals it as a pliable signifier whose semantics have evolved through time. From its originary referent in the Spanish criollo (creole), it has come to refer to people who would have been otherwise entirely alien to this class, viz., the mestizos (both Spanish and Chinese), the principalia (native elite), and eventually, the lowland Catholicized natives themselves. The historical hermeneutic of this identity-discourse in Padre José Burgos’ Manifiesto yields the fact that what gives the term “Filipino” its semantic consistency as a class concept is its essential constitution as a Hispanic and Catholic identity. -/- Second, from this semantic identification of the term “Filipino” as a Hispano-Catholic identity, we proceed to clarify the meaning of Filipinization in terms of the nationalist propaganda carried out by the Filipino ilustrados in the fortnightly periodical La Solidaridad. Here, the specific ilustrado construction of Filipino identity as a Spanish citizen (ciudadano Español) is revealed precisely as a political and legal construct that served as the basis for their own politics of social inclusion/exclusion. Filipinization can only be applied to those who have been hispanized and Christianized and never to those tribes who have resisted and remained outside Spanish colonial authority. Filipinization is thus revealed as a process of Hispanization and Christianization whereby the recipients of Spanish colonial hegemony are transformed into the religiously docile bodies of the Spanish Empire. -/- From this highly determinate context, the study proceeds to examine Rizal’s ontological grounding of collective Filipino-ness in the mythological construction of the pre-hispanic past as the source of a unique Filipino ancestrality. In his work on de Morga’s Sucesos, what is revealed is a mythologization that grounds a native, essential Filipino identity within a past unscathed by the Spanish colonial experience. Such mythologization, however, can only be possible through an anachronistic nationalist interpretation of historical data. Here, Filipinization is revealed as an exclusive prerogative, a nationalist program by which Rizal and the ilustrado class can combat the evils and excesses of the Spanish colonial enterprise. Ironically, though, this same struggle for emancipation also became an instrument by which the ilustrado class can retain their unjustified position of power over those who belonged to the colonial underside, thus, securing the possibility of perpetuating their own ilustrado bourgeois class interests. -/- Such discursive complicity is the essence of the myth of Filipinization: it presents nationalist identity discourse as an anti-colonial enterprise while being underlined by an economy of motives designed to cater primarily to the exclusive interests of the elite and ilustrado class. Thus, instead of securing the genuine, inclusive emancipation of all colonial subjects and a more humane existence for the poor and suffering majority, ilustrado nationalism has, ironically, merely reinforced those operative structures of colonial discrimination and oppression when the ilustrados: 1) grounded their racial theory upon the very same discourse of Eurocentric superiority that they are precisely supposed to question and 2) claimed a patrimony over Filipinas as their exclusive sovereign inheritance. These two factors illustrate how the manifest transfer of power from the Spanish Empire to the Philippine sovereign nation (and later as a nation-state) illustrate how Filipinization merely has transmogrified the face of Spanish colonialism into its new, subtle, and worse form in Filipino nationalism. -/- In this vein, the existence of the 19th century modern Philippine nation merely masked and deferred the crisis that was supposed to transfer power from the Spanish Empire to the multitude of the poor and suffering native indio majority. This crisis became all the more difficult to address be-cause of the duplicitous character of the discourse of Filipinization itself. It has not only effectively transferred power into the hands of the nationalist elite but also captured authentic emancipatory discourse within the identity-trap against which it can only hope to get out. This study concludes with the claim about the impossibility of ever escaping and overcoming the epistemic and practical violence necessarily contained within the historical discourse of colonialism. Or simply, we have no language or discourse that would enable us to overcome the complicity of Filipinization with the very (epistemic) violence against which it has set itself. (shrink)

With its June 2004 statement Catholics in Political Life, the United States Conference of Catholic Bishops opened an important and far-reaching discussion about how Catholic individuals ought to comport themselves in political life, and-indirectly-about how Catholic institutions-including Catholic law schools-ought to decide whether or not to give awards, honors, or platforms to those whose views about key moral and political issues may differ from the views expressed in the teachings of the Catholic Church. On (...) the basis of a simple and straightforward reading of the 2004 statement, it might appear that the bishops wanted to say that no Catholic institution-and thus no Catholic law school-should give awards, honors, or platforms to those who endorse or promote views that differ from the fundamental moral teachings of the Church. An important part of the statement plainly declares: "The Catholic community and Catholic institutions should not honor those who act in defiance of our fundamental moral principles. They should not be given awards, honors or platforms which would suggest support for their actions." A few moments of reflection will reveal, however, that the issue here is somewhat more complicated than what one might infer from a simple and straightforward reading of the statement. The aim of the present paper is not to settle the question of whether and how a Catholic law school ought to give awards, honors, or platforms to certain individuals or groups. Instead, the aim is to begin articulating some of the underlying conceptual issues that perhaps ought to be addressed in preparation for answering the further question of whether and how a Catholic law school ought to give awards, honors, or platforms to certain individuals or groups. As such, throughout its history, the Church has always found the pastoral and juridical means to care for the good of the faithful. With the Apostolic Construction Anglicanorum coetibus, promulgated on 4 November 2009, the Holy Father, Pope Benedict XVI, provided for the establishment of Personal Ordinariates through which Anglican faithful may enter, even in a corporate manner, into full communion with the (...) class='Hi'>Catholic Church. On that same date, the Congregation for the Doctrine of the Faith published Complementary Norms relating to such Ordinariates. In conformity with what is established in Art, I and 1 and 2 of the Apostolic Coinstitution Anglicanorum coetibus, having received requests from a considerable number of Anglican faithful, and having consulted with the Australian Catholic Bishops Conference, the Congregation for the Doctrine of the Faith. The National Conference of Catholic Bishops has argued for significant government involvement in health care in order to assure respect for what they regard as the right to health care. Critics charge that the bishops are wrong because health care is not a right. In this article, it is argued that these critics are correct in their claim that health care is not a right. However, it is also argued that the premise that health care is not a (...) right does not imply that the market is the most equitable and just system for providing health care. Natural law arguments in the tradition of Roman Catholic social teaching lead to the conclusion that a just and prosperous society has a moral obligation to provide health care even if there is no such right. Further, there are strong moral grounds for concluding that the bishops are correct in their claim that health care ought not to be considered a market commodity. It is argued that if health care ought not to be considered a commodity, then national health insurance is the best available alternative for fulfilling the social obligation to distribute health care resources justly and fairly at this time in American history. The bishops' case for government involvement can be made on the strength of the Catholic tradition in theological argumentation, independent of the claim that health care is a right. (shrink)

The Second Vatican Council has a special significance in Latin America. This is especially true due to the influence of the document Gaudium et Spes. This took place at the Medellín Conference when Bishop Marcus Gregorio McGrath, C.S.C., pointed to this influence through his keynote address “The Signs of the Times.” He was prepared for this moment through his earlier theological training in Europe and his pastoral missions, especially in Chile and Panama. It was his earlier practice of (...) class='Hi'>Catholic Action among young lay persons that led him into the “bridge theology” that was to be promoted further by Pope Francis. (shrink)

One of the reasons that prompted Malawi’s Catholic bishops to write a pastoral letter in 1992 that triggered the movement towards democracy was the big gap between the rich and the poor. The pastoral letter, Living Our Faith, emerged as a critical voice in challenging the socio-economic and political state of affairs. The bishops demanded that the government ensures fair distribution of wealth. Since that time, Malawi has experienced different political parties that have assumed state governance after promising to (...) eradicate poverty in their campaign manifestos. Despite political changes, Malawi continues to experience the very same challenges, which prompted the Catholic bishops to write the pastoral letter in 1992. This contribution drew on the notions of dislocation and discontinuity to explore the significance of the pastoral letter towards commemorating the 30th anniversary of this historical event in Malawi. Living Our Faith marked the end of one-party dictatorial regime and the beginning of a multiparty system of governance, something to be celebrated as dislocation. This research interrogated the custodianship of the 1992 Catholic bishops’ pastoral letter and suggested that intellectuals should facilitate socio-political and economic transformation and demonstrated the relevance of the pastoral letter as a blueprint for socio-economic transformation in Malawi.Contribution: This research contributes to the evaluation of progress in the role played by the Church and intellectuals in the development of Malawi.
